ConsentTool is a digital tool developed by WorkHardPlayHard BV (hereinafter “the provider”) enabling organisations to easily collect consent for the use of photo and/or video material. ConsentTool provides a technical platform for collecting and archiving digital signatures.
ConsentTool is a technical tool and not a legal service provider. The provider is not a lawyer, legal adviser or compliance expert. The content of ConsentTool — including the standard clause texts, forms, guides and all other information — is provided for indicative purposes only and does not constitute legal advice.\n\nThe standard texts available in ConsentTool are drafted as general guidelines. They are not tailored to the specific situation, sector, legislation or jurisdiction of the user. The provider does not guarantee that these texts comply with applicable legislation in your country or region.
The user (the organisation using ConsentTool) is fully and solely responsible for:\n\n• The content of the clause texts used, both standard and customised texts\n• The legal validity of consents collected in the applicable jurisdiction\n• Compliance with the GDPR and any other applicable data protection legislation\n• Informing data subjects about their rights\n• The correct storage and processing of collected data\n\nWe strongly recommend that users have the clause texts reviewed by a legal adviser or DPO before going live.
The provider is not liable for any direct or indirect damages arising from:\n\n• The use or misuse of the standard clause texts\n• Errors, omissions or outdated information in the clause texts\n• The legal (in)validity of consents collected via ConsentTool\n• Texts entered or modified by the user themselves\n• Technical failures, data breaches or other incidents outside the provider's reasonable control\n\nThe provider's liability is in any case limited to the amount paid by the user in the preceding 12 months.
The user acts as data controller for personal data collected via ConsentTool. The provider acts as data processor. Data is stored on servers within the European Union. Personal data is not sold to third parties.
The software, design, standard texts and all other elements of ConsentTool are the property of WorkHardPlayHard BV. Users receive a limited, non-exclusive licence to use the platform in accordance with these terms.
The provider reserves the right to amend these terms at any time. Registered users will be notified by email of material changes.
These terms are governed by Belgian law. Disputes shall be settled by the competent courts of the district of Ghent.
